O Conselho Nacional de Justiça e o Conselho Nacional do Ministério Público aprovaram, nesta quinta-feira (9), uma norma conjunta que estabelece regras para o pagamento de benefícios adicionais a magistrados e integrantes do Ministério Público.

A medida atende a uma decisão recente do Supremo Tribunal Federal (STF), que determinou limites para esses valores extras, conhecidos como penduricalho, por ultrapassarem, quando somados aos salários, o teto constitucional de R$ 46,3 mil.

Apesar da orientação da Corte, os dois conselhos autorizaram a manutenção de alguns benefícios, como o auxílio-moradia e a gratificação voltada à proteção da primeira infância e à maternidade. Pela decisão do STF, auxílios como moradia, natalidade e creche deveriam ser encerrados.

A resolução também manteve válidas autorizações concedidas até 30 de março para licença remunerada destinada a cursos no exterior e pagamento por participação em atividades de ensino ou concursos. Esses benefícios também estavam entre os que deveriam ser suspensos após o julgamento do Supremo.

No entendimento firmado no dia 25 de março, os ministros do STF definiram que indenizações, adicionais e gratificações não podem ultrapassar 35% do salário dos próprios ministros, usado como referência do teto. Com isso, os rendimentos mensais de juízes e membros do Ministério Público podem chegar a cerca de R$ 62,5 mil, considerando salário e adicionais.
