  • O TJ-DF determinou a reativação dos radares eletrônicos em rodovias federais, desligados por falta de recursos.

  • A decisão atende a ação popular de 2019 e visa evitar riscos à segurança no trânsito devido ao aumento de velocidade nos trechos sem fiscalização.

O Tribunal de Justiça do Distrito Federal determinou, nesta segunda-feira (18), que o governo federal reative os radares eletrônicos em rodovias sob responsabilidade da União. Os equipamentos haviam sido desligados por falta de recursos.

De acordo com informações do Departamento Nacional de Infraestrutura de Transportes (DNIT) apresentadas no processo, o custo anual do sistema é de aproximadamente R$ 364 milhões. No entanto, o orçamento de 2025 destinou apenas R$ 43,3 milhões para essa finalidade.

Na decisão, a juíza Diana Wanderlei destacou que a suspensão do serviço representa um “apagão das rodovias” e coloca em risco a vida de motoristas, diante do aumento da velocidade em trechos sem fiscalização.

Conforme a determinação, o DNIT deverá notificar em até 24 horas todas as concessionárias para que religuem os equipamentos, sob pena de multa diária de R$ 50 mil por radar inoperante. Além disso, o órgão terá 72 horas para apresentar as consequências da paralisação e indicar o valor necessário para manter o funcionamento integral do sistema.

A União, por sua vez, terá prazo de cinco dias para apresentar um planejamento orçamentário que assegure a continuidade do serviço.

A decisão atende a uma ação popular movida em 2019 pelo senador Fabiano Contarato (PT-ES), após o então presidente Jair Bolsonaro (PL) anunciar a retirada dos radares de fiscalização.
